TRUST ADMINISTRATION

WHAT IS TRUST ADMINISTRATION?

It is the job of the Successor Trustee to administer the trust.  This means the Successor Trustee must collect the trust assets, maintain them, provide accountings, and distribute them to the appropriate beneficiary according to the terms of the trust and the applicable law.  The trust and the Probate Code lays out the instructions and rules a Successor Trustee must follow throughout the administration of the trust.

If the Successor Trustee isn't doing his/her/their job, and you're a frustrated beneficiary of the trust, then you have options which may include having a new trustee appointed by the court.

Additionally, if there were assets left outside of the trust worth more than $184,500.00, part of the trust administration may also involve Probate or a Heggstad Petition.
